Art.68 certificate of approval

First The manufacturer or importer of new motor vehicle, farm tractor, motorcycle, streetcar or a trailer and items of equipment or parts is required to obtain for each new type of vehicle, the subject of their equipment and the certificate of approval issued by the minister responsible for transport.
Second The obligation referred to in paragraph. 1, does not apply to a manufacturer or importer of a passenger car with a combustion engine, farm tractor, motorcycle and moped, which obtained for each of these vehicle approval certificate issued in accordance with Community approval procedure by the competent authority of the European Union.
Third The obligation referred to in paragraph. 1, does not apply to a manufacturer or importer of equipment or vehicle parts, which obtained for these items of equipment or part of the approval certificate issued by the competent authority of the European Union.
4th The manufacturer or importer referred to in paragraph. 2, is obliged to give the minister responsible for transport of information obtained type approval certificate along with the technical data and information about the vehicle referred to in art. 80b, data stored in the register, para. 1 point 1-4 and paragraphs. 1a, paragraph 1, if the technical description does not include them.
5th For the manufacturer, referred to in paragraph. 1, it is also an assembler or construction vehicles.
6th Provision of para. 1 relates to the installation of adapting a vehicle type Gas Supply and how it is mounted by the various actors.
7th Approval certificate is issued for a fee based on the results of certification tests consisting in checking whether a type of vehicle, object or part of its equipment comply with the conditions specified in:
1) The provisions of art. 66, the technical requirements of the vehicle involved in the movement, and paragraphs. 19;
2) the regulations annexed to the Agreement concerning the adoption of uniform technical prescriptions for wheeled vehicles, equipment and parts which can be used in vehicles and the reciprocal recognition of approvals granted on the basis of these prescriptions, done at Geneva on 20 March 1958 (Journal Laws of 2001, No. 104, item. in 1135 and 1136), adopted for use by the Polish Republic, as amended, effective as of the date of its entry into force;
3) Article 8 of the Act of 20 January 2005 on the recycling end of life vehicles (OJ No 25, pos. 202).
8th Minister responsible for transport or entity authorized by him may perform an inspection of production of vehicles, items of equipment or parts, of the type approval, as to their compliance with the terms of the approval certificate.
9th The costs of certification tests, conformity of production, collection and processing of information referred to in paragraph. 4, covers the manufacturer, importer or body making the installation of adapting a vehicle type gas supply.
10th For the production of that vehicle type by the various approval tests shall be carried out separately for each version of the vehicle.
11th If you change the conditions on which the certificates of approval, the manufacturer or importer is required to obtain a change certificate of approval held to extend the type approval certificate of the vehicle, equipment item or component.
12th In the event of changes in the type of vehicle, equipment item or part-altering conditions on which the certificate of approval, the manufacturer or importer is required to obtain a change certificate of approval held to extend the type approval certificate of the vehicle, equipment item or component.
13th Changing the type-approval certificate is issued for a fee after verifying that the vehicle type, an object or part of its equipment comply with the conditions specified in art. 66, the technical requirements of the vehicle involved in the movement, and paragraphs. 19, and the regulations referred to in paragraph. 7, point 2
14th Vehicle type approval certificate shall expire if:
1) The manufacturer or importer of the vehicle, in the cases referred to in paragraph. 11 and 12, did not get the changes to the certificate;
2) The manufacturer will decide on the final completion of manufacture of your vehicle.
15th Vehicle manufacturer or importer shall present the minister responsible for transport, for 60 days before the expiry of the certificate of approval, information on the expiry of vehicle type approval certificate, indicating the reason and date of expiry and the VIN of the last vehicle of a type compatible with expired approval certificate .
16th Minister responsible for transport issues shall revoke the certificate of approval if it finds that a vehicle, item of equipment or part not meet the conditions specified in the certificate of approval and the manufacturer or importer did not remove the incompatibilities within 90 days of their discovery.
17th The provisions of paragraphs. 1-16 does not apply if the vehicle:
1) historical;
2) was built using the body, chassis or frame structure own brand which is referred to as "SAM";
3) Special or used for special purposes of the Armed Forces, Police, Border Guards, tax inspection, the Customs Service, Prison Service and Fire Brigade;
4) produced or imported in quantities of one item per year, does not apply to trams and trolley buses.
18th Vehicles referred to in paragraph. 17 point 1 and 2, are to be audited as to compliance with technical conditions, which are carried out at the expense of the applicant.
19th Minister responsible for transport issues in consultation with the Minister responsible for Internal Affairs and Minister of National Defence shall, by regulation:
1) The conditions and procedures for issuance, amendment and revocation of certificates of approval in terms of the existing approval process, the scope and manner of conducting approval tests, conformity of production or assembly of the conditions of approval, samples of documents related to certification and entities authorized to conduct certification tests, inspections conformity of production or assembly of the conditions of approval
2) The fees for issuing certificates of approval and the change is not higher than the equivalent average exchange rate of EUR 1,000, przeliczanego of gold at the average exchange rate published by the Polish National Bank on the last day of the year preceding the adoption of Regulation
- Having regard in particular the provisions of EU law and international agreements concerning the certification tests and the costs of issuing the approval certificates and changes depending on the scope of the certificate.
20th Minister responsible for transport issues shall specify, by regulation, the detailed method of transmission and processing of data and information about the vehicle referred to in art. 80b, data stored in the register, para. 1 point 1-4 and paragraphs. 1a, paragraph 1, and fees relating thereto, and no higher than the equivalent average rate of 100 euros, przeliczanego of gold at the average exchange rate published by the Polish National Bank on the last day of the year preceding the adoption of a Regulation for a certificate of type approval or patterns of change and the documents used in this area, whereas the efficiency of the operation of the registration process and registration of vehicles, the possibility of obtaining a correct identification of vehicle type approval certificate issued by the competent authority of another Member State of the European Union and the costs of preparing the information on these vehicles for the registration and registration of vehicles.
21st Minister responsible for transport, considering the need to ensure safe use of vehicles referred to in paragraph. 17 point 1 and 2, and the scope of the technical conditions of these vehicles to be tested, shall, by regulation, the scope and method of testing of vehicle compliance with the technical specifications, samples of documents related to these studies and the entities authorized to conduct these tests.
